Automatic Copyright Protection from the Moment of Creation: What It Means for Authors

Copyright is fixed automatically from the moment a work is created. This means that protection arises immediately, without the need for prior registration or formalities.
This principle is based on international agreements, especially the Berne Convention for the Protection of Literary and Artistic Works, to which Moldova is a party.

What automatic protection means

Once a work is created and takes a tangible form (text, music, artwork, photo, architectural design, software, database), the author immediately gains exclusive rights.
The author may reproduce, distribute, publish, translate, license, or transfer rights.
Registration with AGEPI or other authorities is not required for rights to exist.
Registration remains optional but useful as evidence in disputes.

Importance for authors and creators

  1. Fast and free protection. No fees or certificates needed.
  2. Legal protection from day one. Authors can sue for plagiarism or unauthorized copying.
  3. Flexibility in the digital era. Enables quick responses to online infringements.

Additional protection measures

  • digital tools (watermarks, blockchain, metadata);
  • voluntary registration with AGEPI;
  • archiving drafts, files, communications;
  • clear contracts with clients transferring rights.

New challenges

  1. From 2025, online platforms must respond faster to author complaints.
  2. Growing number of disputes over authorship.
  3. Users risk fines or criminal liability for unauthorized uploads.

Practical relevance

  • freelancers: protection is automatic, but keep proof of authorship;
  • companies: sign contracts transferring rights;
  • investors/publishers: verify rights during due diligence.

Conclusion

Automatic copyright protection simplifies enforcement, but registration, blockchain tools, and contracts strengthen protection in courts.
